Okay, it's time. It's finally time. This is the class I had a hard time in and I have learned many lessons from this class so, whether or not the advice is useful, you will get it all. The only other law papers I think I had a slightly hard time with would be my personal and real property law papers. But in comparison, Judicial Review is probably the one I had the most difficulty with.
So, these are some of the topics you may look at in this class:
- illegality
- unreasonableness
- delegated legislation
- ouster clauses
- procedural fairness
- remedies
The point of this class is to get law students familiar with the process of judicial review. What is judicial review? It is basically the process where courts/judges review decisions made by corporations and entities that are acting with legal authority. Essentially, the courts will look at whether that decision was made in accordance with the law and rules in place.
Here's my advice: read the cases multiple times! In my case, I cannot tell you how much I regret not reading the Wednesbury case more than twice. I read it twice and both times I didn't really understand what the case was about and even after discussing it in class it still wasn't very clear. So, what did I do? I (briefly) gave up on that case. It was only roughly four weeks afterwards that I finally figured out what it was about while I was discussing it with my best friend - and by that time I had exams coming up. So, read the cases as many times as necessary.
Some more advice: pay attention to the minor details! For my final exam, one of the questions was about deference and let me tell you the word 'deference' was only used three times in my lectures (and my lecture notes) and I had zero notes about it for my final exam notes and I ALMOST FAILED. I had to write a whole essay about it and I'm lucky I remembered some of it from memory. Maybe my final exam was just a nightmare, but I would rather you be safe than sorry, so focus on the minor details. Learn from my experience.
Also, I would advise you to ask a lot of questions. Ideally, I would hope you ask questions in all your classes but for this class, I really want to emphasise it. Again, maybe it was just me but this was one of those classes where a lot of concepts and ideas were still unclear and I regret not asking as many questions as I should have. I did figure things out with my study group, but these discussions only happened near the end of the semester when we were all stressed with final exams. So again, please learn from my experience.
Ultimately, I did pass this class! It wasn't the grade I wanted but it got me through and I'm just happy I made it. So, I really hope my advice for this class helps you out. Until next time, thanks for reading and I hope you have a lovely day.
